Explanatory Notes
In order that the Rights of the composers are protected for a specific Rights Period, anyone submitting (by fax or post) their work to the Scottish Music Centre's Composition Chart is required to complete and submit two contracts:
Why is this necessary?
If your work is not already registered with MCPS/PRS and in addition, PPL, it is important to complete these licences in order that your original work is protected.
MCPS (Mechanical Copyright Protection Society) "collects and distributes 'mechanical' royalties generated from the recording of music into many different formats. This income is distributed to their members- writers and publishers of music".
PRS (Performing Right Society) "collects licence fees for the public performance and broadcast of musical works".
PPL (Phonographic Performance Limited) "is the UK collecting society for record companies and performers. PPL licenses radio stations, TV stations and other broadcasters who use sound recordings (records, tapes, CDs etc) in their transmissions".
1. Licence A
A contract which relates to the Composition itself.
The person who has written the composition (music/lyrics) should complete and submit the Composition Licence unless they have registered the composition with MCPS/PRS.
2. Licence B
A contract which relates to the Composition itself.
The person who owns the recording of the composition should complete and submit the Recording Licence unless they have registered the recording with PPL (Phonographic Performance Limited).
N.B. The recording may also be owned by the person who wrote the composition
The Rights Period will be deemed as beginning on the day the composition is received by the Centre. Should a composer decide to end the Rights Period at any time, they should notify the Centre in writing. The Centre will then withdraw it within 7 days of receiving that written notification.
Archive
Compositions will be archived indefinitely unless a composer wishes their work to be removed, in which case they should contact the Centre.
